Can I use an AI assistant on WhatsApp Business in 2026?
Yes, to serve your clients. Since 15 January 2026, Meta’s terms stop AI providers from offering their assistant as the main product on the WhatsApp API (the typical «ChatGPT on WhatsApp»). An assistant that answers your business’s clients and books their appointments is customer service, and the terms allow hiring an AI provider for that.
Below is the text of the rule with its link, what is and is not allowed, and the country exceptions. This is general information, not legal advice; we checked it on 27 October 2026.
The demo is a customer-service AI assistant on the official API: try it.
What the rule says exactly
- The ban: AI providers may not use the WhatsApp Business Platform «when such technologies are the primary (rather than incidental or ancillary) functionality» of what they offer. Meta Terms for WhatsApp Business Platform, clause 4.7.
- What the same clause allows: «you may retain an AI Provider as your Solution Provider», that is, a business using AI to serve its own clients.
- The date: Meta refers to its terms «updated on January 15, 2026». Meta documentation.
- Country exceptions: in Italy, Brazil, the European Union and European Economic Area, and Türkiye, Meta allows general-purpose assistants where the law requires it, with a separate charge.
- Who decides: Meta reserves the right to determine «in its sole discretion» what counts as an AI provider. Nobody can promise you Meta approves it.
What is and is not allowed
| Use | Allowed on the API? |
|---|---|
| An assistant that answers your business’s clients, resolves questions and books appointments | Yes: it is customer service, the AI is ancillary to the business |
| A bot that sends reminders, confirms or reschedules appointments | Yes |
| Offering «ChatGPT on WhatsApp» as a product, to anyone, on any topic | No, except for the country exceptions |
| Using your clients’ chats to train a general-purpose AI model | No: the terms forbid it; only fine-tuning a model for your exclusive use is allowed |
If you use AI, also take care of the basics: messages the client asked for, approved templates to write outside the 24 hours, and handing the chat to a person when needed.
This is what a customer-service assistant looks like
The demo is the same kind of assistant we set up for a business: it answers about the business, takes the client to the form and books the appointment.
Frequently asked questions
Did Meta ban ChatGPT on WhatsApp?
Meta banned AI providers from offering their assistant as the main product on the WhatsApp API, from 15 January 2026. That affects services like «ChatGPT on WhatsApp». It does not stop a business from using AI to serve its clients.
Is my WhatsApp appointment bot allowed?
According to the terms, yes: serving your clients and booking their appointments is a business use, and the AI is ancillary. The clause expressly allows hiring an AI provider as your solution provider. The final decision, though, is Meta’s.
Can my number be shut down for using AI?
Meta can limit access for anyone who breaks its policies, with or without AI. What protects you is using the official API, talking only about your business, sending messages the client asked for and not using unofficial tools.
Does the rule apply in Brazil or Europe?
With exceptions: in Italy, Brazil, the European Union and European Economic Area, and Türkiye, Meta allows general-purpose assistants where the law requires it. For a customer-service assistant nothing changes: it is allowed everywhere.
What about Meta Business Agent?
